OVERVIEW

Welcome to Silent Zone. The terms “we,” “us” and “our” refer to Silent Zone.

Silent Zone operates this website and online store, including all related information, content, features, tools, products and services, to provide customers with a considered and curated shopping experience—the “Services.”

Silent Zone is an elevated ritual-wear brand creating thoughtfully designed garments for women moving between stillness, movement and everyday visibility. Our pieces are produced in Peru in limited quantities using carefully selected materials, including organic Peruvian Pima cotton where expressly stated in the applicable product description.

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced within them, explain your rights and responsibilities when using the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

SECTION 1 — ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence.

If you permit a minor dependent to access the Services through a device you own, purchase or manage, you are responsible for supervising their use of the Services.

Our Services are not directed toward children under 13, and we do not knowingly collect personal information from children under 13.

To access certain features or make a purchase, you may be asked to provide information including your name, email address, billing information, payment details and shipping address.

You represent that all information you provide is accurate, current and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to present our products accurately, including their colors, fabrics, textures, measurements and construction.

However, product colors and appearance may vary depending on the device, screen settings and lighting used to view the website. We cannot guarantee that your device will display every color or texture accurately.

Many Silent Zone pieces are handmade or produced in limited quantities. Slight variations in stitching, texture, finish, color placement or measurement may occur. These natural variations reflect the individual craftsmanship of each garment and will not automatically be considered defects.

Natural fibers and fabrics may soften, fade or change subtly with wear and washing. Customers must follow the care instructions provided with each garment.

We do not guarantee that a product’s fit or appearance will meet every customer’s personal expectations. Customers are responsible for reviewing the applicable size guide, product measurements and fit information before purchasing.

Product descriptions may be updated when necessary. We reserve the right to discontinue products or limit the quantities offered to any person, geographic region or jurisdiction.

SECTION 3 — MATERIALS, ORIGIN AND SUSTAINABILITY CLAIMS

Material, origin and sustainability statements apply only to the product, component or practice expressly identified.

Descriptions such as “organic Peruvian Pima cotton,” “100% Pima cotton,” “handmade in Peru,” “natural fiber” or “limited edition” apply only where specifically stated in the relevant product description or garment label.

Not every Silent Zone product or component necessarily has the same material composition, certification, origin or environmental characteristics.

We aim to communicate our materials and production practices clearly and responsibly. Sustainability-related language should not be interpreted as a representation that a product or our entire supply chain has no environmental impact.

Product labels will provide the applicable fiber-content, country-of-origin and care information required for that garment.

SECTION 4 — ORDERS

When you place an order, you are making an offer to purchase the selected products.

Your order is not accepted until Silent Zone confirms its acceptance or dispatches the order. An automated order acknowledgment confirms that we received your order but does not necessarily constitute acceptance.

We must receive and process payment before accepting an order.

Please review your order carefully before submitting it. Once an order has entered processing or production, we may be unable to accommodate changes or cancellation requests.

We reserve the right to accept, decline, limit or cancel an order when reasonably necessary, including when:

  • A product is unavailable.

  • Product or pricing information contains an obvious error.

  • Payment cannot be authorized.

  • Order information is incomplete or inaccurate.

  • We reasonably suspect fraud or unauthorized activity.

  • The order appears to be intended for unauthorized resale.

  • A customer attempts to circumvent a product limit.

  • We cannot deliver to the address provided.

If we decline or cancel an order after payment has been collected, we will issue a refund to the original payment method.

We will attempt to notify you using the email address, billing information or telephone number provided with the order.

Purchases are subject to our Refund Policy [LINK].

Unless separately authorized by Silent Zone, you represent that products are purchased for personal or household use and not for commercial resale.

SECTION 5 — PRE-ORDERS, MADE-TO-ORDER AND LIMITED-EDITION PRODUCTS

Certain products may be offered on a pre-order or made-to-order basis. This will be clearly disclosed on the applicable product page before purchase.

Production and shipping dates for these products are estimates unless expressly stated as guaranteed. Small-scale production, material availability and the handmade nature of our garments may affect these estimates.

If we cannot ship an order within the promised period, we will provide a revised shipping date and any cancellation or refund option required by applicable law.

Products made according to a customer’s individual measurements, specifications or personalization may be ineligible for change-of-mind returns when this restriction is clearly disclosed before purchase.

This restriction does not apply to products that arrive damaged, defective, incorrect or materially different from their description.

Some Silent Zone products are made in quantities as small as three pieces per style. Limited-edition availability is not guaranteed until an order has been accepted. Limited-edition status does not remove any rights regarding damaged, defective or incorrectly supplied products.

SECTION 6 — PRICES, TAXES AND BILLING

Prices, discounts and promotions may change without notice.

The price charged will be the price shown when the order is placed and will appear in the order confirmation. An obvious pricing or technical error may be corrected as permitted by applicable law.

Unless expressly stated otherwise, listed prices do not include sales taxes, shipping, handling, customs duties, tariffs, import taxes or brokerage fees.

Applicable sales tax and shipping charges will be calculated and displayed during checkout when required.

Prices displayed on our website may differ from prices offered by physical boutiques, wholesale partners or third-party retailers carrying Silent Zone products. Third-party retailers independently determine their prices and policies.

We may offer promotions governed by additional terms. If promotional terms conflict with these Terms, the specific promotional terms will apply to that offer.

You agree to provide current, complete and accurate purchasing, payment and account information. You agree to update this information when necessary so we can process transactions and contact you.

By submitting payment information, you represent that:

  • The information is accurate and complete.

  • You are authorized to use the selected payment method.

  • Charges incurred will be honored by the payment provider.

  • You will pay the total amount displayed at checkout.

SECTION 7 — PROMOTIONS, DISCOUNTS AND EARLY ACCESS

Promotional offers and discount codes are subject to the conditions communicated with the offer.

Unless otherwise stated:

  • Only one promotional code may be used per order.

  • Codes cannot be combined with other offers.

  • Codes cannot be exchanged for cash.

  • Codes cannot be applied after their expiration date.

  • Codes cannot be applied retroactively.

  • Shipping, gift cards and selected products may be excluded.

  • Promotions apply only while qualifying products remain available.

Silent Zone may reject or cancel the use of a promotion that has been obtained, altered, duplicated or used fraudulently or contrary to its stated conditions.

Joining the Silent Zone community or early-access list may provide advance information or an earlier opportunity to shop selected collections. Early access does not guarantee product availability and does not reserve a product, size or color.

An order is secured only after it has been submitted and accepted.

SECTION 8 — SHIPPING AND DELIVERY

Available shipping methods, prices and estimated delivery periods are provided at checkout or in our Shipping Policy [LINK].

We will have a reasonable basis for any shipping estimate communicated to you. If we cannot ship your order within the promised timeframe, we will provide any delay notice, revised shipping date and cancellation or refund option required by applicable law.

Delivery dates are estimates unless expressly stated otherwise.

We are not responsible for delays caused by shipping carriers, customs processing, severe weather, strikes, government actions or other circumstances outside our reasonable control. This does not limit any rights you may have when an order is not shipped or delivered as required by law.

Customers are responsible for providing a complete and accurate shipping address.

Risk of loss and title pass as permitted by applicable law. Nothing in this section limits any rights concerning products lost or damaged before delivery.

If tracking indicates that an order was delivered but you cannot locate it, please contact the carrier and Silent Zone promptly.

SECTION 9 — INTERNATIONAL ORDERS, CUSTOMS AND IMPORT CHARGES

Silent Zone products may be shipped from Peru or another disclosed fulfillment location.

Orders entering the United States or another country may be subject to customs processing, duties, tariffs, taxes, brokerage charges or other fees imposed by governmental authorities or carriers.

Unless checkout expressly states that these costs are included, they are the customer’s responsibility.

Silent Zone does not control these charges and cannot guarantee their amount. Customers should consult their local customs authority before ordering if they need an estimate.

If an order is refused or unclaimed because of customs charges, the customer may be responsible for the reasonable shipping, return, customs and processing costs incurred, to the extent permitted by law.

SECTION 10 — RETURNS, EXCHANGES AND REFUNDS

Returns, exchanges and refunds are governed by our Refund Policy [LINK], which is incorporated into these Terms.

Silent Zone accepts eligible change-of-mind returns requested within [14] calendar days after delivery.

Unless otherwise stated in our Refund Policy, returned products must be:

  • Unworn, except for briefly trying them on.

  • Unwashed and unaltered.

  • In their original condition.

  • Returned with their original tags.

  • Free from makeup, deodorant, fragrance, stains, pet hair and other signs of wear.

Products clearly marked “Final Sale,” gift cards, personalized products and other disclosed non-returnable items may be excluded from change-of-mind returns where permitted by law.

A final-sale designation does not remove any rights concerning a product that arrives damaged, defective, incorrect or materially different from its description.

Customers are responsible for change-of-mind return shipping costs unless otherwise stated. Silent Zone will cover reasonable return costs when the return results from a damaged, defective or incorrectly supplied product.

Approved refunds will be issued to the original payment method. Original shipping charges may be non-refundable for change-of-mind returns unless otherwise stated or required by law.

SECTION 11 — DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

Please inspect your order after delivery.

If a product arrives damaged, defective or incorrect, contact us at sabrinaguti@silentzoneapparel.com within [7] days after delivery where reasonably possible.

Include:

  • Your name.

  • Your order number.

  • A description of the issue.

  • Clear photographs of the product and packaging, where applicable.

Failure to report an issue within this suggested timeframe does not eliminate any non-waivable right available under applicable law.

After reviewing the claim, Silent Zone may provide a repair, replacement, refund or other legally appropriate remedy.

Damage caused by accidents, normal wear, improper washing, alterations, incorrect storage, misuse or failure to follow care instructions is not considered a manufacturing defect.

SECTION 12 — INTELLECTUAL PROPERTY

The Services—including all trademarks, brand elements, garment designs, collection concepts, text, photographs, displays, graphics, reviews, videos, audio and the arrangement of such content—are owned by or licensed to Silent Zone and are protected by U.S. and international intellectual-property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only.

Without our prior written consent, you may not:

  • Reproduce, distribute or republish our content.

  • Modify or create derivative works from our content.

  • Publicly display or commercially exploit our content.

  • Download or store substantial portions of the Services.

  • Use our photographs, videos or designs to advertise another product.

  • Use the Silent Zone name in a manner that implies an unauthorized partnership or endorsement.

Nothing in these Terms grants you a license or ownership right under any patent, trademark, copyright or other intellectual property belonging to Silent Zone, Shopify or another party.

The Silent Zone name, logos, product names, designs, collection names and slogans are trademarks or proprietary brand assets of Silent Zone or its licensors.

Shopify’s names, logos, product names and designs belong to Shopify. Other names and marks appearing through the Services belong to their respective owners.

All rights not expressly granted are reserved.

SECTION 13 — OPTIONAL TOOLS

We may provide access to tools offered by third parties, including payment services, sizing tools, review platforms, affiliate technology and other shopping features.

We do not necessarily monitor or control these tools.

Access may be provided “as is” and “as available,” subject to the terms and privacy practices of the applicable provider.

Your use of optional third-party tools is at your discretion. You should review and understand the third party’s terms before using the tool.

We may introduce new features, tools and resources in the future. Unless otherwise stated, they will form part of the Services and will be subject to these Terms.

SECTION 14 — THIRD-PARTY LINKS AND RETAILERS

The Services may contain content or links provided or operated by third parties.

We are not responsible for evaluating or guaranteeing the accuracy, availability, security or practices of third-party websites.

If you leave the Services to access a third-party website, you do so at your own discretion.

Silent Zone products may also be available through independent boutiques, retreats, pop-ups or other retailers. Purchases made through a third-party retailer are governed by that retailer’s prices, return policy and terms unless otherwise expressly agreed.

Questions or complaints concerning a third-party purchase should first be directed to the retailer from which the product was purchased.

SECTION 15 — RELATIONSHIP WITH SHOPIFY

Silent Zone is powered by Shopify, which enables us to provide the Services.

However, purchases made through our store are made directly from Silent Zone. Shopify is not the seller of Silent Zone products and is not responsible for fulfilling orders, processing returns or addressing product claims.

To the extent permitted by law, you release Shopify and its affiliates from claims arising solely from sales transactions between you and Silent Zone.

Nothing in this section limits liability that cannot legally be excluded.

SECTION 16 — PRIVACY

Personal information collected through the Services is governed by our Privacy Policy [LINK].

Certain information may also be processed by Shopify under Shopify’s applicable privacy terms. Shopify’s consumer privacy information is available at Shopify Privacy.

Because Shopify hosts the Services, information concerning your access, use and purchases may be transmitted to Shopify and to service providers supporting our store.

These providers may process information in countries other than your country or state of residence.

Please review our Privacy Policy for information about how Silent Zone, Shopify and our service providers collect, use, disclose and protect personal information and how you may exercise applicable privacy rights.

SECTION 17 — MARKETING COMMUNICATIONS

By subscribing to Silent Zone emails, you agree to receive marketing communications in accordance with the consent you provide.

You may unsubscribe at any time using the link included in a marketing email.

If we offer SMS marketing, separate SMS terms and consent disclosures may apply. Consent to receive promotional emails or text messages is not a condition of purchase.

We may continue to send transactional messages necessary to process and service an order.

SECTION 18 — FEEDBACK, REVIEWS AND CUSTOMER CONTENT

If you submit, upload, post, email or otherwise provide ideas, suggestions, reviews, photographs, videos, comments or other content—collectively, “Feedback”—you grant Silent Zone a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, publish, distribute and display that Feedback for the purposes communicated when it was submitted.

You retain ownership of your original content.

Tagging Silent Zone on social media does not automatically grant us unrestricted permission to use identifiable content in paid advertising. We will request additional permission where legally required or reasonably appropriate.

You represent that:

  • You own or have permission to provide the Feedback.

  • Your Feedback reflects your honest experience.

  • You have disclosed any payment, gifted product, discount or other incentive connected to the Feedback.

  • Your Feedback does not infringe another person’s copyright, trademark, privacy, publicity or other rights.

  • Your Feedback is not unlawful, abusive, defamatory, obscene or misleading.

  • Your Feedback does not contain malware or harmful code.

We are not required to keep Feedback confidential, pay compensation for it or respond to it unless separately agreed.

We may moderate or remove Feedback that violates these Terms. We will not suppress or misrepresent an authentic customer review solely because it expresses a negative opinion.

SECTION 19 — AFFILIATES, CREATORS AND BRAND PARTNERS

Affiliates, creators and brand partners who receive gifted products, discounts, commissions, payments or another material benefit must clearly disclose their relationship with Silent Zone when discussing or promoting the brand.

Disclosures must be clear, easy to notice and placed with the relevant content.

Participation in the Silent Zone Affiliate Program is subject to separate Affiliate Program Terms and Conditions.

Nothing in these Terms creates an employment, agency, partnership or joint-venture relationship between Silent Zone and an affiliate, creator or independent collaborator.

SECTION 20 — ERRORS, INACCURACIES AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, materials, measurements, pricing, promotions, shipping costs, delivery estimates or availability.

We may correct errors and update information when necessary.

We may cancel an order affected by a material or obvious error, including after submission, where permitted by law. If payment has already been collected for a canceled order, we will issue a refund.

If a correction materially affects an accepted order, we will contact you and provide any remedy required by applicable law.

SECTION 21 — PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services:

  • For an unlawful, fraudulent or malicious purpose.

  • To violate applicable international, federal, state or local law.

  • To infringe our intellectual property or another person’s rights.

  • To harass, abuse, threaten, defame or harm another person.

  • To transmit false, deceptive or misleading information.

  • To distribute spam, unauthorized advertising or similar solicitations.

  • To impersonate another person or organization.

  • To interfere with another person’s use of the Services.

  • To submit malware or harmful code.

  • To collect or track personal information without authorization.

  • To reproduce, sell, resell or commercially exploit the Services.

  • To bypass security, access or authorization measures.

  • To use automated tools to access or extract content in violation of these Terms or applicable law.

We may suspend or terminate access if we reasonably determine that you have violated these Terms.

SECTION 22 — AUTOMATED AGENTS

This section applies if you use or deploy automated or semi-automated software to access or interact with the Services.

Automated agents must not:

  • Conceal that an interaction is automated.

  • Impersonate a human user.

  • Circumvent CAPTCHAs or access restrictions.

  • Avoid measures intended to limit or block automated access.

  • interfere with the Services or the experience of other customers.

  • Collect information or content without authorization.

Where technically applicable, an automated agent must accurately identify itself.

We may use technical measures to restrict or prevent automated access.

SECTION 23 — TERMINATION

We may suspend or terminate your account or access to the Services when we reasonably believe you have violated these Terms, engaged in fraud, threatened the security of the Services or used the Services unlawfully.

Termination does not eliminate payment obligations incurred before termination.

Provisions that by their nature should survive termination will remain in effect, including those addressing intellectual property, Feedback, warranties, liability, indemnification, governing law and privacy.

SECTION 24 — DISCLAIMER OF WARRANTIES

Except as expressly stated by Silent Zone or required by applicable law, the Services are provided “as is” and “as available.”

To the fullest extent permitted by law, we do not guarantee that:

  • The Services will always be uninterrupted, secure or error-free.

  • Website information will always be complete or current.

  • Products will meet every customer’s subjective expectations.

  • Product colors will appear identically on every screen.

TO THE FULLEST EXTENT PERMITTED BY LAW, SILENT ZONE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

Some states do not permit the exclusion of certain implied warranties. In those states, these exclusions apply only to the extent permitted by law.

Nothing in these Terms excludes an express written warranty or consumer right that cannot legally be waived.

SECTION 25 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, SILENT ZONE AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PURCHASE OF A PRODUCT.

THIS MAY INCLUDE LOST PROFITS, LOST REVENUE, LOST DATA OR SIMILAR LOSSES, EVEN IF WE WERE ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, SILENT ZONE’S TOTAL LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct or personal injury where applicable.

Some states do not permit certain limitations of liability. In those states, the limitations apply only to the extent permitted by law.

SECTION 26 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Silent Zone, Shopify and our respective affiliates, directors, officers, employees, agents, contractors, licensors and service providers from third-party claims arising from:

  • Your material breach of these Terms.

  • Your unlawful use of the Services.

  • Your infringement of another person’s rights.

  • Content you submit through the Services.

This provision does not require you to indemnify Silent Zone or another party for its own negligence, unlawful conduct or willful misconduct.

We will provide reasonable notice of an indemnifiable claim. You agree to cooperate in its defense by providing relevant information and documents.

SECTION 27 — EVENTS OUTSIDE OUR CONTROL

Silent Zone will not be responsible for a delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, strikes, transportation interruptions, customs delays, governmental actions or significant supply-chain disruptions.

We will take reasonable steps to minimize the effect of the event and communicate material delays.

Nothing in this section eliminates cancellation, refund or other rights required by applicable law.

SECTION 28 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted or severed from these Terms.

The remaining provisions will continue in effect.

SECTION 29 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms does not waive that right.

These Terms and the policies incorporated by reference constitute the entire agreement between you and Silent Zone concerning your use of the Services.

These Terms supersede prior or contemporaneous communications and proposals relating to the Services, whether oral or written.

Nothing in this section limits representations or rights that cannot legally be excluded.

SECTION 30 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations as part of a merger, acquisition, restructuring, sale of assets or similar business transaction, subject to applicable law.

SECTION 31 — GOVERNING LAW AND DISPUTES

These Terms and any separate agreement through which Silent Zone provides the Services are governed by the laws of New York City, New York, without regard to conflict-of-law principles.

Any dispute will be brought before the competent courts of the State of New York and the local government of New York City, unless applicable consumer law allows or requires otherwise.

This choice of law does not remove any non-waivable consumer protection available under the laws of the customer’s state or jurisdiction of residence.

Before beginning formal legal proceedings, you and Silent Zone agree to make a reasonable effort to resolve the dispute informally by contacting the other party.

SECTION 32 — HEADINGS

The headings used in these Terms are provided for convenience only and do not limit or otherwise affect their interpretation.

SECTION 33 — CHANGES TO THESE TERMS

You may review the current version of these Terms on this page at any time.

We may update these Terms to reflect changes to the Services, our business practices or applicable law.

When required by law, we will provide notice of material changes. Updates will become effective on the date stated in the notice or when posted.

The version in effect when an order is placed will normally govern that purchase. We will not retroactively apply material changes in a manner that unlawfully reduces an existing customer’s rights.
